This Agreement, and all of the applicable documents referred to in this Agreement (collectively, the “Agreement”), is a legal agreement between Users and Registrants of Westchester Virtual Homes, a LLC company (“You” and “Your” and “Users”) and EJI INC a Limited Liability Company governing the use of the site and digital products whether visiting or registering, purchasing products and services.
You agree that You have read, understood, and agreed to be bound by this Agreement and will comply with all of the terms and conditions of this Agreement. If You do not agree to be bound by this Agreement, You are not permitted to use any part of the site or its services.
OWNERSHIP OF PHOTOS AND VIDEO
Westchester Virtual Homes owns all rights to all media supplied. All photos & videos provided to You are solely and exclusively owned by Westchester Virtual Homes. Westchester Virtual Homes reserves all rights of ownership including but not limited to the distribution, publication, alteration, sale and duplication of any and all photos provided to You through the services for whatever reason in. Upon purchasing and paying in full for the services received, You are granted a limited, terminable, non-exclusive license to use the photos and other services provided to You by Westchester Virtual Homes in any legal manner You should choose. You are not, however, granted a license to sell, transfer, license, and sub-license or otherwise distribute the services, any component of the service, or any products or services derived or developed from or based on the service to any third party. You may transfer the service to their MLS provider for the sole purpose of fulfilling the defined purposes of the MLS provider. Such transfer of this limited usage license to the MLS shall not in anyway be construed as a transfer of ownership to the MLS.
PAYMENT AND SCHEDULING AND REFUNDS
If for any reason the service is needed to be rescheduled, it must be communicated with Longs Peak Media via phone, text or email at least 24 hours before said scheduled service to avoid a fee. This includes postponing, canceling and changing of time.
Your card may be charged a scheduling fee at the time of scheduling that will be deducted from the total invoice price at the end of the service. Or you may be charged in full before any service is provided.
If for any reason at the sole discretion of Westchester Virtual Homes a refund needs issued, your card will be fully refunded within 24 hours not including any time it takes for the bank to add the
balance back to your account. If a fee is assessed due to any reason above, it will not be refunded.
Scheduling is based on a first come first serve basis. We do not guarantee any specific time or date even if it shows as available on the schedule. Westchester Virtual Homes will take your choice in to consideration and schedule to the closest available spot possible. Westchester Virtual Homes reserves the right to reschedule and notify you of the changes at any time before or during the scheduled time. It is always the homeowner’s and/or agent’s responsibility to prepare the property for the photo shoot, Westchester Virtual Homes is not responsible for homes that are not in ‘show-quality’ condition at the time of the photo shoot.Westchester Virtual Homes shoots all photos of the property in “as-is” condition.
ADDITIONAL FEES
Westchester Virtual Homes reserves the right to charge additional fees due to cancellations, rescheduling, travel time, and reshoots. Once a Westchester Virtual Homes photographer has photographed a home, cancellation/rescheduling will not result in a refund. Travel Fees may be charged if properties are out of the area of service. Our service area is provided on our website WestchesterVirtualHomes.com or by email.
If any additional services are added after the scheduling has been submitted, all applicable fees will be added to the end invoice. If invoice was paid in full, an additional invoice will need paid to pay for new services
Westchester Virtual Homes reserves the right to change all service fees at any point in time without notice.
Virtual Staging services are final once project has been submitted. You most provide exact details of what virtual staging you want and where or allow Westchester Virtual Homes to choose on your behalf before submission of project. After project is done, no changes can be made without paying a fee per photo to alter anything within.
